A competent person is generically defined as someone who, through certified training and experience, is knowledgeable of regulations, policies and laws regarding occupational health and safety and is capable of identifying hazards relating to their specific workplace and operations, and has the authority invested in him or her by their employer to correct the hazards to protect workers.  In the OSHA construction standards (see 29 CFR 1926.32(f)), a Competent Person is defined as "one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them". 

There is no single OSHA construction standard that establishes all of the specific responsibilities of a “Competent Person”.  Instead, there are numerous references to a Competent Person that appears in the various OSHA construction standards.  Some of the OSHA Construction Regulations (
OSHA fall-protection, scaffolding, excavation & shoring) list some specific requirements for a variety of topics, such as safety meetings or hazard assessment, to be performed by the “Competent Person”, while other construction standards only make a passing reference to the Competent Person.  The Competent Person is also referred to in several final OSHA rules, OSHA Interpretation Rulings, or OSHA directives.
